General terms and conditions of business

  1. scope

    • These General Terms and Conditions (GTC) apply to all business relationships between POC Bautrade GmbH, Hilgerstr. 14, 45141 Essen, represented by the Managing Director Markus Wieszala, and its business customers as well as to sales via the online shop and at the sales location Hilgerstraße 14.

  2. conclusion of the contract

    • In the B2B sector, contracts are concluded through a written order from the customer and a written order confirmation from the seller. In the online shop and at the point of sale, the contract is concluded through the customer's order and the subsequent order confirmation by the seller.

  3. Prices and payment terms

    • Prices in the B2B area are agreed individually and are net plus statutory VAT and shipping. At the point of sale and in the online shop, the final prices are stated including VAT and shipping costs. Payment terms and conditions are agreed individually in the B2B area, while at the point of sale and in the online shop the payment methods offered there apply.

  4. Delivery and Shipping

    • In the B2B sector, delivery is made at the customer's expense and risk, and the delivery time is agreed individually. At the point of sale, the sale takes place directly and without shipping. In the online shop, delivery is made to the address provided by the customer within the specified delivery times.

  5. retention of title

    • The goods remain the property of the seller until all claims arising from the business relationship in the B2B area have been paid in full or until the order has been paid in full at the point of sale and in the online shop.

  6. warranty

    • The warranty is based on the statutory provisions. In the B2B sector, obvious defects must be reported immediately.

  7. Liability

    • The seller's liability is limited to foreseeable, contract-typical damage, unless the damage is due to injury to life, body or health.

  8. data protection

    • The seller undertakes to treat all information received within the scope of the business relationship as confidential.

  9. severability clause

    • Should individual provisions of these General Terms and Conditions be invalid or unenforceable in whole or in part, or should they later lose their legal validity or enforceability, this shall not affect the validity of the remaining provisions. The invalid or unenforceable provisions shall be replaced by an appropriate provision which, as far as legally possible, comes closest to what the seller would have wanted in accordance with the spirit and purpose of the invalid provision. The same applies if the General Terms and Conditions prove to be incomplete.

  10. final provisions

    • The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. The place of jurisdiction is Essen.
